(Collectively the parties mentioned above shall be referenced as the “Defamation Parties”)
Subject: Request an apology for the slanderous attack on me as a communist and receiving instructions from the Communist Party of Vietnam to destroy the unity of the Vietnamese community according to CCC Section 48a
Ladies and Gentlemen,
Pursuant to Article 48a of the California Civil Code and the California Senior Citizens Protection Law,
I, Nguyen Phuong Hung, request all Defamation Parties to publicly retract their slander and
apologize to me acts of defaming my character and falsely accusing me of being an agent of the
Vietnamese Communists and affecting my health immediately within 20 days from the date of receipt of
This letter (“Notice”) to the following incidents of defamation and intimidation against me:
Defamation and Threats of Assault No. 1:
On February 22, 2023 around 7.15 to 7.30 pm after I spoke at Westminster city council meeting in the
“Oral Communications” section regarding the Award Ceremony of Mayor Chi Charlie Nguyen
presented a certificate of honor to Mr Chanh Huu Nguyen (aka Tony Chanh Nguyen) for the reason of
not determining Mr. Tony Chanh Nguyen’s contributions to the community. Immediately after I left, a
man named Doan Ly (?) took the initiative attack me. It is known that Mr. Doan Ly, a martial arts
master of the political organization named Alliance of Vietnamese People (abbreviated as AVP),
stopped me in the hallway of the city meeting room when I left. He walked towards me and asked:
“Hey! Nguyen Phuong Hung, what did you say about my boss Nguyen Huu Chanh?”
I didn’t answer and continued walking towards the door to leave but he immediately jumped forward and
raised his fist to attack me. Mr. Doan Ly is about 6’0″ tall and weighs approximately 170 lbs compared
to me who is 5’3″ tall and weighs 138 lbs. I am 78 years old in 2023 and of course weak, so in
self-defense I shouted loudly “Help, help, help”. I think Police Chief Darin Leyni and everyone inside
the meeting room heard my cries for help, so the police officers at the meeting promptly stopped the
unfortunate incident.
Mr. Doan Ly may be receive instructions from Mr. Chanh Huu Nguyen or Mayor Chi Charlie Nguyen to
publicly slander and humiliate me at the meeting. This is a complete violation of Westminster city
meeting rules. According to the city’s Oral Communications rules, Mr. Doan Ly cannot use a public
meeting that recorded in the city’s video to personally attack me, because:
1. Oral Communications only discusses administrative matters related to the City of Westminster.
2. Do not attack the privacy of individuals who are not present or individuals who are not city
officials.
3. The slander and fabrication are based on personal hatred for the purpose of defaming my
reputation.
Watching the video on February 22, 2023, you will see that the City Council was completely wrong
because Mayor Chi Charlie Nguyen and Westminster attorney Christian Bettenhausen tolerated Doan
Ly’s freedom to speak in an insulting manner. Blatantly slandering me personally about stories unrelated
to the city and accusations were too bad without evidence. To be exact, Mayor Chi Charlie Nguyen and
city attorney Christian Bettenhausen did not stop him, but seemed to tacitly agree to allow Mr. Doan Ly
to say all the slanderous and insulting words about me right at the forum in 3 minutes. The time length
that the city allows each person to speak.
Because of the silent attitude by the city of Westminster through Mayor Nguyen and Attorney Christian
Bettenhausen or because they had a previous conspiracy, does Mr. Doan have the right to slander and
humiliate others publicly at the meeting? In the past, many people including me have been prevented or
prevented from talking about other people or topics other than city issues by the City Lawyers and
Mayor. Why this time, these two people with the authority to stop, the Mayor (Chairman) and the
Lawyer (Adviser), let Mr. Doan Ly, this AVP member, use the public forum during the city’s meeting on
the 22nd February,2023 after I left and attacked me with accusation and slandering me as a communist
and working for the Communist Party of Vietnam to destroy the solidarity of the Vietnamese
community in the United States. (Exhibit 1)
Defamation No. 2:
On May 10, 2023, Mr. Doan Ly repeated the same old defamation which he said on February 22, 2023.
It was still a fabrication and slander that I was a communist and worked for the Communist Party of
Vietnam to destroy the solidarity of the Vietnamese community in the United States.
City officials please tell me that Westminster City Council section (Oral Communications) is a place of
free slander and I have no right to defend?
Defamation No. 3:
Mr. Tony Bui, a city employee working on the city’s Planning Commission and also the English
interpreter for Mr. Doan Ly, used his cell phone to show a picture of me wearing a red T-shirt and
Yellow Star for tourists (Vietnam flag symbol). This man, at least twice on February 22 and May 10,
2023, showed me wearing a fashionable T-shirt via his personal phone while he spoke. All of Mr. Tony
Bui’s actions were also not stopped by the Mayor and City Attorney. Please let me know, is there any
law that prohibits not wearing a shirt with the national flag of any country while traveling? The image
that Mr. Tony Bui brought out was an attempt to incite the Vietnamese community in Orange County to
attack me. Mr. Tony Bui wanted to convince everyone that I was a Communist, so he tarnished my
image when I returned to Vietnam to travel or work as journalist by wearing a fashionable T-shirt for
tourists (a red shirt with a yellow star.) I am from Vietnam and is there any wrong to travel as journalist?
That person is always alert and on guard against someone attacking me to the detriment such as assault
and injury or death (Exhibit 2 & 3). In The United States today is no longer a safe country for me and is
full of intimidation, slander, barbarism and death through the images of Doan Ly and Tony Bui and the
silent non-intervention of the Mayor and Lawyer in the city.
Ladies and gentlemen,
On December 8, 2023, Deputy Mayor Namquan Nguyen confirmed: “The Red Star Yellow Flag is the
flag of Vietnam that the United Nations recognizes as well as many US Presidents who have paid
diplomatic visits after Vietnam and the United States” after the re-establishment of diplomatic relations

Remember, I am not a public figure and do not hold any position in the city. I am a communist refugee
who has lived in the United States for 48 years after April 30, 1975. I am currently retired and am not
running for any elected office position and am not affiliated with a communist community organization
nor belong to any Vietnamese group and local people. I use the power of the media to contribute to
making the lives of Westminster and Orange County residents as well as America better. I fulfilled my
civic duty after coming to America to study Information Technology and go to work. I fully fulfill my
obligations as a US citizen: pay taxes, have no criminal or misdemeanor convictions and am the only
Vietnamese person in Orange County elected as a honor citizen in two cities with large Vietnamese
refugees is Westminster and Garden Grove.
Public opinion at Westminster has talked a lot about a power group established by three people in 2020
by Westminster Councilmen at that time, including: former Mayor Tri Ta (now California congressman,
district 70), Councilman Chi Charlie Nguyen (now Mayor) and Councilwoman Kimberly Ho (now
separated from the group.) They manipulated and created group power with a 3/5 majority vote, so they
took revenge on me and waited for an opportunity. Assembly to suppress my voice if possible.
I am a freelance journalist and a resident of Westminster for 48 years, so I feel it is my duty to contribute
my voice to the activities of the Westminster city council to help the city become more and more
beautiful as it is called “All America City”. I once participated in the project to build the Vietnam War
Memorial monument, Westminster – Successfully organized 3 Tet Parades event in 2007, 2008, 2009
and was not in debt to the city of Westminster, if not profitable; Unlike most organizations the Tet
Parades from 1993 until now, the City of Westminster has only lost money or lacked money. I have
never participated in Oral Communications sessions before 20020 and only started speaking out since
the political power group “Gang-of-Three” was established and has openly oppressed and destroyed the
community since 2020. All my opinions are purely constructive and only do the job that the city allows,
which is to bring up negative or disadvantages related to residents’ lives through Westminster
community meetings. Please refer to the Westminster videos featuring my input during the Oral
Communications sessions.
So why does Westminster’s political power group “Gang-of-Three” hate me? As a journalist full of
conscience and profession, I have frankly presented the cases of fraud, lack of information and So why
does Westminster’s political power group Three Peoples Bang hate me? As a journalist full of
conscience and profession, I have frankly presented the cases of fraud, lack of information and
fabricated biographies during the election of Mayor Chi Charlie Nguyen and Deputy Mayor Namquan
Nguyen of Westminster City. Both of them lied about their university degrees to falsify their personal
records when running for election in 2020 and 2022. I asked these two people to give copies of their
university graduation certificates but they did not do so. This ignorance make thing even worse by the
city of Westminster and the Electoral Commission (ROV) also did not intervene after I brought my
complaint to the Westminster city parliament. The falsely educated certificates wasn’t carefully screen.
Was it the political “Godfather” force of lawyer Tran Thai Van that pressured the City to remove my
complaint? They blatantly violated the 4th Amendment of freedom of speech and went even further by
using the city’s public forum to let people from powerful political groups openly shout and threaten to
silence them. No one in the press or the people dares to tell the truth like me.
I feel uneasy because all the agendas of the city of Westminster have been publicly recorded and shown
on the cable TV system, so most city residents in Westminster as well as neighboring cities in the
Orange County, United States or worldwide tracking. The current estimate of Orange County’s
population is more than 3 million. I don’t know how many people have followed this slander case, but it
is certainly very large, if not all but the most Vietnamese here believe that I am a Communist as they
Accused. Further, in September 2019, the city of Westminster issued Resolution 4953, which
condemned and opposed those affiliated with the Communist Party of Vietnam, in which they referred
to me through the paragraphs “Where As” (attached to Resolution 4953).
Personally, since the end of 2019 until now, I have not gone to Vietnam to do reportage because of the
Covid-19 pandemic and especially my old age, this year I am 78, so my health does not allow me to
continue my journey as a reporter about the country of Vietnam, where I was born. But why am I
condemned as a lackey for the Vietnamese government when the United States and Vietnam have
re-established diplomatic relations 26 years after the war? President Joe Biden’s most the recent trip on
September 2023 marked the highest level of comprehensive strategic partnership in relations between
the United States and Vietnam. It cannot be assumed that anyone comes to Vietnam is Communist, even
if they are wearing fashionable clothes that has the Vietnamese flag symbol when traveling to
Vietnam. The Socialist Republic is just a name for the current Vietnamese regime and has nothing to do
with my life and especially America, we have had 6 presidents come to Vietnam in the past 26 years.
The majority of Vietnamese people in the United States, because of the defeat on April 30, 1975, came
to settle through the compassionate arms of the US government and people, but it is not because of the
past of the government of the Republic of Vietnam that they have the right to move up to condemn any
US citizen who has contact with Vietnam by tourism, business, education, society, politics…etc…etc… I
respect the right to think and freedom of thought of everyone, but no one can cover their mouth and give
themselves the right to slander or freely condemn anyone just for dissent. So, simply by slandering me,
they had the intention and conspiracy to exclude me from the American social community that I had
contributed to since the first day I arrived in the United States on May 6, 1975 so that they could freely
influence society. this association. Up to now, I am even more proud that I have fulfilled my duty as an
American citizen, contributed fully to my civic duties, did not commit fraud or conviction, and
especially I have never applied for social assistance since the first day of my arriving in the US soil
until now.
“Gang-of-Three” also made Resolution 4953 to demagogue people to seek votes by playing the
traditional flag of the Republic of Vietnam yellow with 3 red stripes for political ploy to gain votes. The
flag that I also fought with the soldiers of the Republic of Vietnam as well as more than 600 thousand
American soldiers before April 30, 1975. I served in the Army Rangers of the South Vietnamese army
with the US allies and was wounded on November 30, 1968 and then discharged from the army to work
with the CIA’s peripheral telecommunications agency in Vietnam until On April 27, 1975, I was
evacuated by FEC (Federal Electronics Corporation), an anonymous agency of the CIA, to the service
contractor for the US government in Vietnam, Pacific Architects & Engineering, headquartered in San
Farncisco. I had to evacuated to the United States to avoid the collapse of the South of Vietnam on April
30, 1975. Especially not being retaliated against by the North for working for the CIA and being a
former Army Ranger officer.
Those who slandered me as a lackey of the Viet Cong and worked for the Vietnamese government today
cannot prove it, and having no evidence that I received instructions from the Vietnamese government is
unthinkable and completely fabricated. Convicting someone in the Vietnamese refugee community of
working or being an agent of the Vietnamese government is a sensitive issue. By doing this, they have
tainted the world’s leading US security system, the FBI (domestic) and CIA (foreign affairs). They
disregarded US intelligence when they accused me or anyone living in America of being a communist of
inciting incitement that could cause the death of me and those wrongly suspected. When applying for
permanent residence or naturalization in the United States, they all know that the United States does not
accept anyone who works for a terrorist organization or uses the United States to form a base against any
country with which the United States has diplomatic relations like Vietnam. So is slandering me a form
of silencing journalists like me for speaking out about the real situation of some administrative,
legislative and judicial officials?
I really fear for my safety and that of my family. I’m old and lonely in a society where English and
Vietnamese speak the same language. I just hope to have a peaceful and peaceful life until I die. An
older person like me is probably not a threat to those around me. I was just doing my proper job as a
journalist. I do not want since Resolution 4953 of the City of Westminster to be used as a form of
intimidation of opposition voices and since my name was shown on Times Warner TV of the City of
Westminster with fabricated slanders.
Because I believe in fair and impartial laws, “no one is above the law”, I am writing this letter to ask for your support from the judicial authorities to request the city to officially apologize in writing and publicly. If necessary, I will have to ask the law to intervene. If you don’t apologize, please show proof that I am a member of the Communist Party of Vietnam or that I received instructions from the Vietnamese government to cause division in the Vietnamese community in the United States.
This is the second letter I request “Defamation parties” above to respond within 20 days, according to the law, I will be forced to use the justice to regain honor and justice for a true journalist and an exemplary citizen of the city. All acts of violence, slander, and threats are crimes against me until I receive a letter of apology. I will fight until my last breath to find justice. Evil and wicked people will have no place in a just, secure society like the United States.
I hereby declare that the above information provided is true and accurate. May God protect us with all safety and health.
